Terms of Service
Last updated: October 30, 2026
These terms govern access to and use of Polaris, a marketing-intelligence software-as-a-service platform provided by Orka Growth S.R.L. (CUIT 30-71739101-9), with its registered address at Gorostiaga 2097, Ciudad Autónoma de Buenos Aires, Argentina ("Orka"), to organizations in Latin America and other countries ("customers").
The Polaris service
Polaris helps businesses connect authorized advertising, analytics, and commerce data; build dashboards and reports; receive AI-powered insights; and create, analyze, and manage marketing assets.
Accounts and responsibilities
Organizations and users are responsible for providing accurate account information, protecting credentials, and ensuring that each person who uses a workspace is authorized to do so. Access to Polaris may depend on the organization, workspace, plan, and enabled integrations.
Acceptable use
Customers may not use Polaris to break the law or third-party rights, to access accounts or data they are not authorized to use, to send spam, to interfere with the service or its security, or to resell the service without a written agreement.
Customer data
Customers keep ownership of the data they connect or upload and of the content they create in Polaris. For that data, the customer is the controller and Orka is the processor: Orka processes it only to provide the service and under the customer's instructions, keeps it confidential, protects it with the measures described in the Privacy Policy, uses only the providers listed there, and tells the customer about a security incident that affects it without undue delay. When the subscription ends, the customer can ask to export or delete its data, and we do so within 30 days, except for records the law requires us to keep. Customers can request a signed data processing agreement.
Third-party platforms
Integrations with Meta, Google, TikTok, commerce platforms, and other providers depend on those providers. Their terms also apply, and Orka is not responsible for their outages, limits, or changes. Actions Polaris takes on a connected account, such as publishing an ad, are taken only when a user asks for them.
AI-generated content
Analyses, recommendations, and creatives generated with artificial intelligence can contain errors. Customers should review them before relying on them or publishing them, and they remain responsible for the decisions and content they publish.
Subscription, prices, and cancellation
Polaris is sold as a monthly subscription. The plan, price, currency, and applicable taxes are shown before paying, according to the customer's country. Enterprise plans are priced in a written agreement.
Free trial. A new workspace starts with a free trial that requires no card. Nothing is charged when it ends: the workspace is paused until an administrator picks a plan and pays.
Renewal. The subscription renews automatically every month, on the date of the first payment, and is charged to the registered card until it is cancelled. If a charge fails, it is retried; if it still cannot be collected, the workspace may be paused until the payment is made.
Cancellation. A workspace administrator can cancel at any time from Settings › Credits › Cancel plan, or by writing to [email protected]. No further charges are made, and the workspace keeps working until the end of the period already paid. There are no cancellation fees, and the current period is not refunded except under a right of withdrawal granted by law.
Suspension and termination
Orka may suspend a workspace that breaks these terms or puts the service or other customers at risk, and tells the customer the reason. Either party may end the relationship by cancelling the subscription.
Liability
Polaris is provided as it is offered at each moment. To the extent the law allows, Orka is not liable for indirect damages or lost profits, and its total liability is limited to the amounts the customer paid in the 12 months before the claim. This limit does not apply to fraud, wilful misconduct, or gross negligence, or where the law does not allow it.
Country-specific rules
The mandatory consumer and data protection rules of the customer's country apply even where these terms say otherwise.
- Argentina. Consumers may withdraw within 10 calendar days of the first payment, at no cost and without giving a reason, as provided by section 34 of Consumer Protection Law 24,240, by writing to [email protected]. We refund the full amount through the same payment method. Personal data is protected under Law 25,326.
- Chile. Personal data is processed under Law 19,628 as amended by Law 21,719, and data subjects can complain to the Agencia de Protección de Datos Personales. Consumers keep the rights granted by Law 19,496.
Changes to these terms
Polaris features may change over time. If we change these terms, we publish the new version here and ask users to accept it again. By accessing or using the service, users agree to these terms and to the Polaris Privacy Policy.
Governing law
These terms are governed by the laws of Argentina, and disputes go to the courts of the City of Buenos Aires, unless the mandatory law of the customer's country or a written agreement signed with the customer provides otherwise. A signed agreement prevails over these terms.
